 The Company reserves the right to change these terms and condition at any time. Any such changes will take effect when posted on the website www.thephotorooms.co.uk. It is your responsibility to read these terms and conditions on each occasion you use or purchase services from the Company.

GDPR

The GDPR came into effect in May 2018. It's designed to protect the privacy of individuals in the European Union (EU) and give them control over how their personal data is processed, including how it’s collected, stored and used.

 

GDPR and The Photo Rooms: what you need to know

 

  • Data we will collect and store includes your name/company name, contact telephone number and email in order to make bookings for photoshoots and contact you before and after with necessary information regarding your session.

  • We may ask for your address to see geographically where our customers are coming from to ensure we are marketing the right areas and to send out photographic prints to your home if they are not digital or being collected in store.

  • You have the right to allow or deny permission of the use of your photographs for our portfolio. Your images will be kept on the system for 6 weeks after you place an order. These will then be removed apart from any photographs we have agreed can be used in our portfolio for future customers to see.

  • We may send emails from time to time with updated news or an offer on that is relevant to your reason for using The Photo Rooms as your photographer, but we will ask permission first if we can email you.

  • If you are having makeup and hair styling prior to a photoshoot or as part of a wedding package, we will take some medical history to check for allergies against any products used to ensure your safety. These forms will be erased after 6 weeks of your order.

Promotions

Promotional vouchers are valid for two months from the date of purchase or unless otherwise stated and the photo shoot must be booked within this time but not necessarily conducted.

Vouchers are valid for the number of people and type of shoot stated on the voucher.

Promotional vouchers may not be used in conjunction with any other offer.

Gift Vouchers

Gift vouchers are valid for 6 months unless otherwise stated and Clients who have valid gift vouchers may take advantage of any offers available at the time of booking.

Bookings and cancellations

Our booking office can be contacted anytime during the Company’s working hours. For out of hours please leave us a message and we will return your call as soon as we can.

Photo shoot appointments are available Wednesday-Saturday

We require the £25 photoshoot fee at the time of booking. 

We require 72 hours notice if you wish to reschedule your appointment. However if you cancel or fail to arrive for your shoot it will deem payments made void and will not be refunded. You will be charged a new photoshoot fee at the time of re-booking.

All appointments are made subject to availability.

Our photo shoots do not include any photograph packages or products unless specifically stated as part of a promotion.

You will be emailed a confirmation of your booking along with what to bring, you must let us know immediately by telephoning 02382 025 385 if any details are incorrect.

Photoshoot 

A maximum of three outfit changes are permitted during the photo shoot.

Persons under the age of 18 may only attend with a parent or legal guardian who must remain present throughout the photoshoot.

Clients booking in for boudoir shoots must be over the age of 18; we may ask for photo ID such as a current driving licence or passport to confirm your age.

We request that all Clients arrive 5 minutes before the scheduled appointment so that we are ready to start on time. If you are running late you need to call The Photo Rooms on 02382 025 385 as soon as possible. Please be aware that lateness may shorten the amount of time available in the studio.

On rare occasions due to unforeseen circumstances we may be running behind schedule. The Photo Rooms will endeavor to keep this to a minimum however delays on occasions can occur.

Pricing

The Company reserve the right to change the retail prices at any time.

A full price list of our prints and products are displayed on the Company website www.thephotorooms.co.uk

The price list available to you at your viewing session will be the one that was current at the time of your booking. If you postpone your photo shoot appointment, then the price list that is published at the time of rebooking will be the one available at your viewing session.

All prices stated are in Pounds Sterling (£) and include VAT at the current prevailing rate.

Copyright

For copyright purposes no personal photography or filming is permitted at the studio, use of digital cameras, camera phones, video recorders, or any other photographic/video capture device is strictly prohibited. Any reproduction of photographs before purchase, by scanning, photographing or other methods of copying are illegal.

Copyright remains with the Company.

Once you purchase digital images on CD, the copyright for those images will be released to you on a shared basis.

Right of Publicity

During your photo shoot you will be asked to state on your order form whether you grant The Photo Rooms the right to use your pictures for portfolio purposes, both printed and online advertising and promotional material. You are under no obligation to allow us permission. If permission is granted you will need to provide a signature on the order form.

Cancelling Products

Because the supply of printed photographs, posters and acrylic blocks are outsourced to a fulfillment company and has been made to your personal specification, you do not have the right to a "cooling off" period should you no longer want the finished products. By placing an order with us, you are committing to buy the ordered products.

Payment for the products are made in full at the time of ordering and cannot be refunded.

Refund Policy

Due to the nature of digital photography and the fact that the photographs, once sent, cannot be returned; The Photo Rooms has a strict No Refunds Policy. Once a transaction has been completed, i.e. the buyer has selected and paid for the photographs, it is then non-refundable.

If a buyer has selected and purchased an incorrect photo, he/she must notify The Photo Rooms before receiving the incorrect image. Refunds will not be given for simply not liking an image, selecting an incorrect image after the buyer has already received the image or any other reason.

For digital downloads there are no refunds available once the image has been received.  Should the download fail, The Photo Rooms will allow additional downloads free of charge.

If the wrong image is sent to you, or the documented order is incomplete, The Photo Rooms will send the correct items to you free of charge.

Dispatch

Usb's, prints and additional products ordered will be available within three weeks from the date of your photo shoot. You will be contacted when your order is ready and you should collect from the studio at 81 Bedford Place, Southampton, SO15 2DF unless postal delivery was previously arranged and paid for.

The cost of postage, packaging and delivery is published in the Company price list. All images purchased will be dispatched to the address provided by you at the time of sale.

You will be required to check your photos and products on collection and any problems should be brought to our attention at that time so that we can rectify them.

All photos purchased by yourself will be kept on our files for six weeks from date of purchase. Should you need another copy within this time, we can retrieve it for you; however we will not be held responsible for the loss of any of these images. All other photos are subject to be removed from our files 6 weeks after being taken.

The Company will provide a pleasing colour balance but cannot guarantee exact colour matching due to printing calibration of our suppliers.

Health & Safety

If you have any aversion to flash photography, or any history of medical problems, such as skin allergy, photosensitive epilepsy or mobility issues that may restrict you in certain poses, we will endeavor to accommodate you wherever possible. It is your responsibility to let us know in advance of any special requirements.

Whilst we will always strive to ensure a safe environment within the studio, if you have children it is a parent or guardian’s responsibility to ensure that all they are supervised at all times to avoid danger caused by the misuse, handling or interference of equipment.

Any damage to studio equipment will be charged for at the current market rate of replacement.

The Photo Rooms in no way discriminates against any individual however where a Client is found to be unfit for treatment, we will refuse service on behalf of the staff team. This will include persons of a poor standard of hygiene or any ongoing conditions such as head lice or open sores. We will where possible make every effort to reschedule appointments in such cases.

Security

For your safety and security please be aware that CCTV is in use throughout the premises.

Clients should understand that this is in no way to infringe on their privacy during their time at the studio.

Recorded CCTV footage may be used as evidence against any individual committing a criminal offence on the premises.

The Photo Rooms do not accept liability for the loss or damage of any equipment or personal belongings brought onto the premises.

Data Protection

The Photo Rooms will not share Client data with any third parties.

Your personal information will only be used to contact you regarding your enquiry or booking.

We may occasionally send you promotional electronic communications. Please let us know if you’d rather not receive these communications.

While we make every effort to ensure that both our online and offline systems are secure, we will not be held responsible for any unlawful activity that bypasses this process.

Dispute Resolution

We take complaints very seriously and aim to deal with them in a fair, confidential, quick and effective way.

If you are unhappy with how your hair or makeup has been done, please let us know immediately during the session, so that we can attempt to rectify it.

If you are not entirely satisfied with the images when they are received, you will have seven days to contact us with your concerns.

These terms and conditions are governed by English Law. Any disputes arising out of your use of the Company’s services are subject to the exclusive jurisdiction of the English courts.
